So then, why does Apple refuse to use the WebM open videos format and stick to H.264 which is proprietary _and_ patented _and_ requiring fees?

Flash might be propietary, it is usable free of charge by everyone.

HTML5 video is a plague, since you haven't got a single universally adopted video format., so what?: You want to force sites to provide two video formats to be universal?
