Exactly. Flash is free tu use by everybody, No fees whatsoever.
Not if it's H.264 in a Flash wrapper, it isn't. And that's what much Flash video is these days.
Maybe most people don't care about patented technology with potential fees... Well for 90% of the existing crap, delivering a shaky youtube camcorder .mov clip isn't an issue for many. They paid the fee already with the camcorder or their mobile.
Whenever however H.264 will have got no alternative any more, then the patent holders will begin to hunt the big game...
