Well... I think the Mormons might disagree. And the Native Americans for that matter.

In both cases the >Federal< government effectively legislated against their local religions... long before the 1940s. Federal control of right to religious expression has been part of this country pretty much from the beginning - just not always explicitly so.

The counter-claim is of course that passing a law which happens to outlaw or prevent some aspect of a religion (like the ability to teach it to your children) is not specifically a violation of separation... but it seems pretty specious to me.
